POLICIES

Wayside Commons is a retail environment intended to encourage access and usage by the retail public; however, Wayside Commons is also a private property.

SOLICITATION

No soliciting of any kind is permitted. This includes passing out leaflets, selling goods or services in common areas, collecting donations, petitioning or any other activity that has not been approved in writing by the Management Office. Merchants may allow these activities as long as they are fully contained within your premises.

PROMOTIONAL PARTNERSHIPS

Wayside Commons will consider partnering with entities to raise funds and awareness for cause or for general promotion. If you would like to be considered for such a partnership, please contact the KeyPoint Partners management office.

CODE OF CONDUCT

With the goal of an environment which is enjoyable, safe, clean, and conducive to the retail environment desired at Wayside Commons, the following activites are not allowed:
  • Smoking in the gazebo, at the park benches or patio’s
  • Disruptive or threatening behavior of any kind
  • Excessive staring
  • Sleeping or loitering on the property
  • Climbing on the gazebo, trellis, or water features
  • Violation of verbal or written trespass warnings
  • Possession or consumption of illegal substances
  • Use of obscene language or gestures
  • Use of skateboards, roller blades, or bicycles on pedestrian walkways
  • Parking motor vehicles of any kind outside of marked parking areas
  • Taking of photos, video, or audio recording of any store, product, employee, customer, or officer. Photos of shopping parties with the shopping center décor as background are permitted.
  • Overnight parking or parking a vehicle and leaving the property
  • Any act defined by federal, state or local codes and ordinances that may constitute a crime.
POLICE ASSISTANCE

The Town of Burlington Police Department should be contacted to assist customers and Merchants with accidents, lost children, theft, etc. It is helpful that accidents or incidents in the common areas of the center, such as the parking lot and sidewalks are reported to the Property Manager.

SHOPLIFTING

There will be no service personnel at the center to detain or apprehend shoplifters. If you require such service, you should contact the Burlington Police Department. In-store procedures to respond to shoplifting should be developed and explained to all employees.

OTHER ABHERANT BEHAVIOR

Observations of behavior in violation with public access, code of conduct, or safety violations should be reported to the Town of Burlington police department and to the Property Manager. Please make notes of the observation for completion of a full incident report.

LOST AND FOUND

Any items left in your store or found by employees should be retained according to your corporate procedures, provided to the local police department, or provided to a property management representative. Items of significant monetary value should be reported to the Burlington police department.

RULES AND REGULATIONS

The lease agreement between the Owner and each Merchant has a lengthy Rules & Regulations section. Simplisitically, these rules and regulations are as follows:

  1. No auction, fire, bankruptcy, “lost our lease” or going out of business sales.
  2. Only first-quality merchandise can be sold. No “seconds” or damaged goods, or “outlet” merchandise.
  3. Sales may not occur on the plaza’s or sidewalks adjacent to the Demised Premises
  4. No display of merchandise or distribution of handbills or advertising of any type on the plaza or sidewalks.
  5. The display windows are to be kept clean and electrically lit during and for one hour past the closing time of the center or as requested by the Landlord. Timeclocks should be set to turn off at 10:00 p.m. If you have a later closure time; adjust your setting to one hour past closure.
  6. Deliveries are to occur in the times and manner as designated by the Landlord.
  7. There is no storage of deliveries outside of the premises.
  8. All trash, refuse and the like shall be separated and otherwise disposed as designated at Merchants sole cost and expense.
  9. No signs may be placed on the windows, doors, and entrance lobbies without Landlord(& Town of Burlington) approval.
  10. Signs desired by the Merchant shall be submitted to the Landlord for approval
  11. All interior signs must be professionally prepared.
  12. Avoid any act or practice which may damage the Premises or the Shopping Center.
  13. Do not cause any offensive odors or vibrations or loud noise (including, the use of loudspeakers).
  14. Do not cause a nuisance or menace to any other occupant or persons in the Shopping Center.
  15. Merchants shall at all times keep the Demised Premises fully and adequately stocked and fixtured.
  16. Merchants shall at all times fully an adequately heat and/or air-condition the Premises.
  17. Participate in evacuation drills.
  18. Employ a full staff to conduct business, including a qualified store manager headquartered and working full-time at the Demised Premises to manage and control the operations of the Demised Premises.
  19. Provide the Property Manager with the name, address and telephone number of store manager so that the Landlord will be able to contact the store manager.
  20. Comply with, and cause all occupants to comply with Legal Requirements relating to the protection of human health or the environment and applicable to the use and operation of the Demised Premises (“Environmental Laws”).
  21. Do not use, handle or store or dispose of any oil, hazardous or toxic materials or hazardous or toxic wastes (collectively, “hazardous materials”) in or about the Shopping Center.
  22. If the transportation, storage, use or disposal of any hazardous materials anywhere on the Shopping Center results in (1) contamination of the soil or surface or ground water or (2) loss or damage to person(s) or property, notify Landlord immediately.
  23. Merchant is responsible for compliance with the American with Disabilities Act and the regulations and Accessibility Guidelines for Buildings and Facilities issued pursuant thereto (the “ADA”).
  24. Report roof leaks to the Property Manager immediately. The Landlord is responsible for repairs to the roof; however, if the leak is related to Merchant’s heating, ventilating and air conditioning system the Merchant will be responsible for repair.
  25. Merchants shall obtain and maintain in full force and effect a non-cancelable heating and air conditioning equipment service contract. A current copy of your heating, ventilating, and air conditioning maintenance contract is required to be on file with Management.
  26. Give the Property Manager notice when agents, employees or contractors propose to go upon the roof of the building to make repairs or for any other purpose whatsoever.
  27. Obtain permits before making any repairs, installations, alterations, additions, improvements or removals. A copy of permits shall be provided to the Property Manager.
  28. The Property Manager should be notified of any contractor work in the Demised Premises regardless of the scope of work involved.
  29. Prior to performing any work in the building the contractor and subcontractor must submit a certificate of insurance.
  30. Certificates of insurance shall name Wayside Commons Investors LLC and KeyPoint Partners, LLC. as additional insureds. The following minimum coverage is required: $5,000,000 combined single limit per occurrence for bodily injury and property damage Workers' compensation as required by local and/or state jurisdiction(s).
  31. Arrange with the utility providers for provision of utility services. Below are telephone numbers for utility companies servicing the Shopping Center.
